Hay ocasiones en que, en un mismo acto, se infringen varios derechos del autor. En el caso del usuario chileno de YouTube que adaptó la décima “Al submarino peruano”, de Nicomedes Santa Cruz, para homenajear a la Armada chilena, se infringieron dos derechos: paternidad e integridad.

Por el derecho de paternidad, el autor de una obra tiene derecho a ser reconocido como tal. En este caso, en ningún momento se hace mención del nombre de Santa Cruz.

Por el derecho de integridad, el autor (o sus herederos) tiene la facultad de oponerse a toda modificación o mutilación de su obra. En este caso se hacen varios cambios al texto original: “un peruano submarino” por “superficie y submarino”, “negro vientre” por “rojo vientre”, “cincuenta años” por “cien años”, “si Grau hubiese” por “si Pratt hubiese”.

Cabe resaltar que el derecho patrimonial de las obras literarias dura toda la vida del autor más 70 años, entonces, la obra de Santa Cruz sigue en dominio privado. Pero, incluso en dominio público, las infracciones persistirían: los derechos de paternidad e integridad, por ser morales, son perpetuos.

On occasion, in a same event, several author’s rights are infringed. In the case of the Chilean YouTuber who adapted the décima «The Peruvian submarine», by Nicomedes Santa Cruz to honor the Chilean Navy, two rights were infringed: paternity and integrity[i].

By the right of paternity, the author of a work has the right to be recognized. In this case, Santa Cruz’s name was not mentioned at no point.

By the right of integrity, the author or his heirs are empowered to object to any modification or mutilation of his work. In this case, several changes are made to the original text: «a Peruvian submarine» for «surface and submarine», «black belly» for «red belly», «fifty years» for «one hundred years.» «If Grau had» by «If Pratt had.”

It should be noted that the economic rights of literary works expire 70 years following the author’s death; therefore, the work of Santa Cruz is still in private domain. However, even in public domain, infringements persist: the rights of paternity and integrity, as moral rights, are perpetual.

[i] The Peruvian Copyright Law refers to two types of authors’ rights: moral and economic. Moral rights, including the rights of paternity and integrity, establish that time or any other circumstance cannot affect them, even the resignation of the author.
